Terms of Service

Last updated: October 2, 2026

These Terms of Service (“Terms”) are an agreement between you and Sparkpip Learning Inc. (“Sparkpip”, “we”, “us”, or “our”), a corporation incorporated under the Canada Business Corporations Act with its registered office at 3601 Highway 7 East, Suite 1005, Markham, Ontario L3R 0M3, Canada, covering your use of our AI tutoring service. By creating an account or using Sparkpip, you agree to these Terms. If you do not agree, please do not use the service.

Who can use Sparkpip

You must be at least 18 years old and able to enter into a contract to create an account. Sparkpip is intended for children to use under the supervision of a parent or guardian, who is responsible for their child's use of the service.

We may refuse, suspend, or close an account at our reasonable discretion — for example, where the information provided is inaccurate, where an account appears to have been created by someone under 18 without a parent or guardian, or where the account is being used improperly.

Sparkpip is not offered to residents of Quebec at this time. We are working toward meeting Quebec's privacy and French-language requirements before opening there. By creating an account you confirm you are not a Quebec resident, and we may close accounts that indicate otherwise.

Your account

Please provide accurate information, keep your password secure, and do not share your account. You are responsible for activity that happens under your account. Let us know right away if you believe someone else has accessed it.

Access to your account depends on the email address you signed up with: password resets, parent PIN codes and security notices all go there. You can change that address yourself from the parent dashboard at any time while you can still sign in. To protect your child's information, we do not restore access to an account, or move it to a different email address, on request: if you lose access to your email and can no longer sign in, we cannot open the account for you. You may create a new account, and if you have a paid plan you can stop it through the receipt emails from our payment provider or through your card issuer.

Electronic communications

When you use Sparkpip or contact us, you are communicating with us electronically, and you agree to receive communications from us electronically — including service and account emails and notices we post in the app. You agree that these electronic communications meet any legal requirement that a communication be in writing. Account and service messages (such as receipts, security alerts, and password resets) are a necessary part of the service; you can unsubscribe from optional, non-essential emails at any time.

What Sparkpip does

Sparkpip provides AI-powered tutoring and practice in math, English and science for grades 1–12. It is an educational aid designed to support learning. Because it uses AI, it can occasionally make mistakes or give an imperfect explanation — please double-check anything important and use your own judgment. Sparkpip is not a substitute for a teacher, a school, or professional advice.

AI-generated content and accuracy

Pip, our tutor, is powered by artificial intelligence, and is the same AI tutor in every subject. Everything Pip produces — explanations, answers, hints, practice questions, reading passages, feedback on writing, pictures and diagrams — is generated by AI in the moment. We work hard to make it accurate and we test it extensively, but no AI is perfect: Pip can sometimes be wrong, incomplete, unclear, or out of date, and it can occasionally mark a right answer wrong or a wrong answer right.

Because of that, please keep the following in mind:

  • Pip is a study helper, not an authority. If something Pip says does not match what your child's teacher or textbook says, or simply looks off, trust the teacher and check before relying on it — especially for tests, assignments, and anything that counts toward a grade.
  • Progress information is a guide, not an official assessment. The practice results, accuracy figures, mastery levels, and insights shown in the parent dashboard are calculated automatically from AI-marked practice. They can contain errors, and they are not a grade, a report card, a diagnosis, or a formal evaluation of your child.
  • Curriculum alignment is our best effort, not a guarantee. We organize practice around curriculum documents published by Canadian provincial and territorial ministries of education, and we quote those documents where we can. We do our very best to match each region's curriculum, but we do not promise complete or perfectly accurate coverage: a grade, course, or subject may be missing or only partly covered, an outcome may be omitted or transcribed imperfectly, and Pip may not always teach to the exact outcome shown. Curricula change, some documents are published in draft, and our copy may not always reflect the latest version or what your child's class is covering this week. Where a ministry has not yet published a current document for a grade, or teaches a subject inside an integrated program rather than on its own, or sets its outcomes by developmental stage rather than by grade, we use the most recent document it has published, the relevant parts of that program, or the stages it places in that grade, and we say so in the app where you choose topics. Your child's teacher and school are the authority on what is taught and how it is assessed.
  • Sparkpip is independent. We are not affiliated with, endorsed by, or acting on behalf of any ministry or department of education, school board, school, or teacher. When we name a province's curriculum, we are describing the material we align to — not claiming an endorsement.
  • Pip does not give professional advice. Pip is not a teacher, psychologist, or other professional, and nothing it says should be relied on as an educational, psychological, medical, or other professional assessment or advice.

If you spot a mistake, please tell us at privacy@sparkpip.com. Reports like that are how Pip gets better for every family.

Acceptable use

Sparkpip is for personal, family use. You agree not to:

  • misuse, disrupt, or attempt to gain unauthorized access to the service;
  • scrape, copy, resell, or commercially exploit the service;
  • create accounts to abuse free usage limits; or
  • use Sparkpip for anything unlawful or harmful.

Fair use and service limits

To keep Sparkpip fast, safe, and affordable for every family, all plans — including paid plans — come with reasonable usage limits rather than unlimited access. These currently include:

  • a set number of tutoring sessions per period — for example, per week on the Free plan and per day on paid plans — each with a time limit;
  • a reasonable daily limit on how many messages can be exchanged with the tutor; and
  • automated safeguards that may pause a session after repeated empty, off-topic, or low-effort messages.

The limits that apply to your plan are shown in the app and are set generously for normal learning use. Reaching a limit is a normal part of how the plans work — not a service error — and does not by itself entitle you to a refund. We may adjust these limits over time, and may slow, pause, or restrict usage that is excessive, automated, or that threatens the stability, security, or sustainability of the service for others.

Plans, billing, and cancellation

  • We offer a Free plan and paid subscriptions (Family and Family+).
  • Paid plans are billed on a recurring monthly basis until canceled.
  • You can cancel anytime from your billing settings; your access continues until the end of the period you have already paid for.
  • Prices are shown in Canadian dollars (CAD) and may be subject to applicable taxes.
  • Except where required by law, payments are non-refundable.
  • We may change our prices, and we will give you notice before a change affects you.
  • All plans include fair-use limits (see “Fair use and service limits” above) that keep the service sustainable for everyone.

Your content

You and your child keep ownership of the questions, answers, and other content you submit. You grant us a limited license to process that content as needed to operate, secure, and improve the service, as described in our Privacy Policy.

Our content

Sparkpip — including its name, design, mascot (Pip), software, and content — belongs to us and is protected by intellectual property laws. Please do not copy or reuse it without our permission.

Disclaimers

Sparkpip is provided “as is” and “as available.” We do not guarantee that it will be uninterrupted or error-free, or that it will achieve any particular academic result.

In particular, we do not warrant that content generated by the tutor — including explanations, answers, marking, feedback, practice material, and progress information — or the curriculum alignment we describe, will be accurate, complete, or suitable for any particular purpose, such as preparing for a specific test, assignment, or exam (see “AI-generated content and accuracy” above).

We are not responsible for any loss of content or data, and we recommend keeping your own copy of anything important to you. Any reliance you place on the tutor's output is at your own discretion.

Service availability and changes

We may add to, change, suspend, or discontinue Sparkpip (or any part of it) at any time, and we may carry out maintenance that makes it temporarily unavailable. Where a change is significant, we will try to give reasonable notice, but we are not liable to you or anyone else for any change, suspension, or interruption of the service.

Limitation of liability

To the fullest extent permitted by law, Sparkpip will not be liable for indirect, incidental, or consequential damages. This includes any loss arising from reliance on content generated by the tutor, such as an incorrect explanation, answer, mark, or progress figure. Where our liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim.

Indemnification

You agree to indemnify and hold harmless Sparkpip and its owners, officers, employees, and contractors from any claims, losses, damages, liabilities, and reasonable legal costs arising out of or connected with your use of the service, content you or your child submit, your breach of these Terms, or your violation of any law or the rights of another person. This does not apply to the extent a loss is caused by our own gross negligence or willful misconduct, or cannot be limited under applicable law.

Resolving disputes

If you ever have a concern, please contact us first at privacy@sparkpip.com. Most issues can be resolved quickly and informally, and you agree to give us a reasonable chance to do so before starting any formal proceeding.

Any claim relating to the service must be started within one (1) year after the event that gave rise to it, unless applicable law requires a longer period.

To the extent permitted by applicable law, disputes will be handled on an individual basis rather than as part of a class or representative proceeding. Nothing in these Terms removes any right you cannot waive under the consumer-protection laws that apply to you.

Termination

You can stop using Sparkpip at any time. We may suspend or end your access if you break these Terms, or where needed to protect the service or other users.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You and Sparkpip submit to the courts of Ontario for any dispute that is not resolved informally, except that we may seek an injunction in any appropriate court to protect the service or our rights.

Changes to these Terms

We may update these Terms from time to time. If we make significant changes, we will update the date at the top. Continuing to use Sparkpip after a change means you accept the updated Terms.

General

  • Entire agreement: These Terms and our Privacy Policy are the whole agreement between you and us about the service and replace any earlier understandings.
  • Assignment: You may not transfer your rights under these Terms. We may transfer ours — for example, if Sparkpip is acquired or reorganized — and your information would move with the service as described in our Privacy Policy.
  • Severability: If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver: If we do not enforce part of these Terms right away, we do not give up the right to do so later.
  • Survival: Terms that by their nature should continue after your account ends — such as content licenses, disclaimers, limitation of liability, indemnification, and the dispute terms — will survive.
